1. Overview

BusBrother ("Company," "we," "us," or "our") is a transportation brokerage and booking platform operated by WETYR Corporation. BusBrother connects customers with independent, licensed charter bus and motorcoach operators ("Carriers" or "Vendors") for group transportation services throughout Florida. By using our website, submitting a quote request, or booking transportation through BusBrother, you ("Customer," "you," or "your") agree to these Terms of Service.

2. BusBrother's Role as Transportation Broker

BusBrother is a transportation broker and booking agent, NOT a motor carrier, transportation provider, or vehicle operator. BusBrother does not own, operate, lease, maintain, or control any charter buses, motorcoaches, minibuses, or other vehicles. All transportation services are performed exclusively by independent, third-party licensed Carriers.

BusBrother's role is limited to:

  • Accepting quote requests from customers
  • Soliciting bids from independent licensed Carriers
  • Facilitating communication between customers and Carriers
  • Processing payments on behalf of Carriers
  • Providing booking confirmation and trip coordination

BusBrother does not employ, supervise, direct, or control any drivers, vehicle operators, or Carrier personnel. The relationship between BusBrother and each Carrier is that of independent contractor, not employer-employee or principal-agent.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUSBROTHER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • Any accident, collision, injury, death, or property damage occurring during transportation provided by a Carrier
  • Any acts, omissions, negligence, or willful misconduct of any Carrier, driver, or vehicle operator
  • Vehicle breakdowns, mechanical failures, or maintenance issues
  • Delays, cancellations, or route changes by any Carrier
  • Loss, theft, or damage to luggage, personal property, or cargo
  • Any violation of federal, state, or local transportation regulations by a Carrier
  • Any failure of a Carrier's insurance coverage

In no event shall BusBrother's total aggregate liability exceed the amount of the booking fee or service charge paid by the Customer to BusBrother for the specific transaction at issue. This limitation applies regardless of the legal theory under which liability is asserted, including contract, tort, negligence, strict liability, or otherwise.

4. Carrier Qualifications

BusBrother requires all Carriers in our network to represent and warrant that they:

  • Hold a valid USDOT number and are registered with the Federal Motor Carrier Safety Administration (FMCSA)
  • Maintain all required federal, state, and local operating authority
  • Carry commercial automobile liability insurance with minimum coverage of $5,000,000 per occurrence
  • Employ only properly licensed CDL drivers who have passed background checks and drug testing
  • Maintain vehicles in compliance with all DOT safety standards and inspection requirements
  • Comply with all applicable Hours of Service regulations

However, BusBrother does not independently verify, audit, inspect, or guarantee the ongoing compliance of any Carrier. Customers acknowledge that they are relying on the Carrier's own representations and the Carrier's independent legal obligations.

5. Assumption of Risk

By booking transportation through BusBrother, you acknowledge and agree that:

  • Motor vehicle transportation inherently involves risks of accident, injury, and property damage
  • You voluntarily assume all risks associated with charter bus and motorcoach transportation
  • You are contracting with an independent Carrier for transportation services, with BusBrother acting solely as a booking intermediary
  • Any claims related to the transportation service itself must be directed to the Carrier, not BusBrother

6. Indemnification

You agree to indemnify, defend, and hold harmless BusBrother, WETYR Corporation, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of BusBrother's services
  • Your breach of these Terms
  • Any dispute between you and a Carrier
  • Any claims by third parties arising from the transportation services

7. Insurance Disclaimer

BusBrother does not provide insurance coverage of any kind to customers. All insurance coverage for the transportation services is the sole responsibility of the Carrier. Customers are encouraged to maintain their own personal travel insurance and to verify the Carrier's insurance coverage before boarding.

8. Booking and Payment

  • All quotes are estimates until confirmed by a Carrier
  • Payment is due before the scheduled trip date unless otherwise agreed in writing
  • BusBrother processes payments through Square and distributes funds to Carriers after deducting its service fee
  • Cancellation more than 72 hours before pickup: full refund minus 10% service fee
  • Cancellation 24-72 hours before pickup: 50% refund
  • Cancellation less than 24 hours before pickup: no refund
  • No-shows receive no refund

9. Dispute Resolution

Any dispute arising from these Terms or your use of BusBrother shall be resolved through binding arbitration in Brevard County, Florida, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action proceeding. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action must be filed in Brevard County, Florida.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12. Modifications

BusBrother reserves the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the modified Terms.
